Which areas we record

Our cameras record the entrances to our premises at Rathausgasse 17 and the terrace. Signs on site indicate the video surveillance.

Purposes and legal basis

We use video surveillance in order to

• protect our premises,
• secure the mail and documents we keep for our tenants, and
• investigate incidents.

The legal basis is Art. 6(1)(f) GDPR. The processing is necessary to protect our legitimate interests and those of our tenants; in our assessment, your interests do not override them (see the next section). If, in an individual case, we are obliged to hand over recordings to law enforcement authorities, the legal basis is Art. 6(1)(c) GDPR.

Our legitimate interests

We keep mail, formal deliveries and documents for our tenants, and they have access around the clock. We have a legitimate interest in protecting these items and our premises and in being able to establish what happened if damage occurs; our tenants share this interest.

The cameras cover the entrances and the terrace. Recordings without an incident are deleted once the retention period has expired (see Retention period). In addition, signs on site indicate the video surveillance.

Retention period

Recordings are stored for 72 hours and then overwritten automatically. Within this time it is usually possible to tell whether a burglary, theft or damage has occurred. If we detect such an incident, we secure the relevant sequences and keep them until the incident has been resolved – in the case of a criminal complaint or legal dispute, until its conclusion. We then delete them.

Access and recipients

Only authorised persons at WestX GmbH have access to the recordings.

In individual cases, where this is necessary to investigate an incident, we may pass recordings on to

• the police and public prosecutors,
• courts and lawyers instructed by us, if legal claims are asserted or defended,
• an insurer, if a claim is being settled.

The recordings are stored on a recorder on our premises.

Your rights

With regard to recordings concerning you, you have the following rights:

• access (Art. 15 GDPR),
• erasure, unless we need the recordings to investigate an incident (Art. 17 GDPR),
• restriction of processing (Art. 18 GDPR),
• objection to the processing (Art. 21 GDPR, see below).

An informal message to info@gewerberaum-schoenefeld.de is sufficient. So that we can find recordings of you, please tell us the day, time and place as precisely as possible. Please note that, once the retention period has expired, recordings without an incident have already been deleted. To ensure that your data does not reach unauthorised persons, we may ask you to verify your identity; we make other people in the recordings unrecognisable.

Right to lodge a complaint

If you believe that the video surveillance infringes data protection law, you can lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), in particular in the EU member state of your habitual residence, your place of work or the place of the alleged infringement. Provision of data and automated decisions

You are not obliged by law or contract to provide us with your data. However, anyone who enters the recorded areas is recorded by the cameras. There is no automated decision-making, including profiling, within the meaning of Art. 22 GDPR.
